FIBERME Communications LLC (“FIBERME”) provides warranty coverage exclusively to its certified partners (“Certified Partners”). FIBERME offers Certified Partners a minimum of one (1) year hardware and software warranty from the date of shipment. This warranty applies solely to products sold directly by FIBERME to the applicable Certified Partner seeking coverage. Warranties are non-transferable. Extended warranty coverage is available. Warranty inquiries from end users should be directed to the appropriate Certified Partner. Products purchased from unauthorized dealers or sellers, and products with the original factory serial number removed, defaced, or altered, will not qualify for the original manufacturer’s warranty coverage.
Certified Partners are entities that purchase FIBERME products directly from FIBERME and adhere to FIBERME’s sales and marketing practices.
Hardware Warranty
FIBERME warrants to Certified Partners that all hardware products sold by FIBERME will be free from defects in workmanship and materials under normal use during the specified warranty period. If any product or component is found to have a defect in materials or workmanship, and the Certified Partner notifies FIBERME in writing within the warranty period, FIBERME shall, at its sole discretion, either repair the defective product or component, replace it with an equivalent product or component that meets published product specifications, or refund the purchase price paid by the Certified Partner. Replaced or repaired components, subassemblies, units, or spares are warranted for ninety (90) days or the balance of the original warranty period, whichever is longer.
Software Warranty
FIBERME warrants to Certified Partners that its licensed software programs will perform in substantial conformance with the applicable program specifications during the specified warranty period. FIBERME also warrants that the media containing the software is free from defects in materials and workmanship. During the warranty period, FIBERME guarantees that no intentional protection features will be introduced into the software that would prevent its use. It is acknowledged that software in general is not error-free, and the presence of minor errors does not constitute non-conformance to the applicable program specifications.
Limitation of Liability
For the avoidance of doubt, VoIP equipment is not entirely secure, and FIBERME assumes no liability under this policy for any damages suffered by Certified Partners or end users due to unauthorized access, encroachments, or similar activities. The warranty does not apply to damaged or defective products or components caused by improper use, abuse, incorrect installation, mismanagement, normal wear and tear, faulty storage, usage outside of product specifications, or mishandling outside of carrier conditions.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WARRANTIES AND REMEDIES SET FORTH IN THIS AGREEMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ALL OF WHICH ARE EXPRESSLY DISCLAIMED.
FIBERME’S WARRANTIES APPLY ONLY TO CERTIFIED PARTNERS AND DO NOT EXTEND TO THIRD PARTIES, INCLUDING BUT NOT LIMITED TO END USERS, RESELLERS, AGENTS, OR DEALERS OF CERTIFIED PARTNERS. FIBERME NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME LIABILITY IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE, OR USE OF ITS PRODUCTS. FIBERME MAKES NO WARRANTY FOR NON-STANDARD PRODUCTS SUPPLIED UNDER THIS POLICY.
Warranty Periods
Hardware Warranty to Certified Partners – Minimum of one (1) year from the date of delivery to the Certified Partner. Only applicable for products purchased directly from FIBERME.
Software Warranty to Certified Partners – Minimum of one (1) year from the date of delivery to the Certified Partner. Only applicable for products purchased directly from FIBERME.
Extended Warranty to Certified Partners – Extended warranties may be purchased within the original warranty period for up to three (3) years in total. Extended warranties are only available for products purchased directly from FIBERME.
